  • Will: LOW Names included but no reason, date or signature

    Q. 1.With Letter of Wishes, how do these work?

There are no details of the reason for why 3 blood children get a lesser share. Just the mere fact it exists on the will file and created a month before the will is signed is odd but hey - what do I know.

Q.2. What claim can the children make where they do not get an equal share like other siblings and they get 19% less than a step child?
The will was "arranged" by the step sister and she takes 95% for her and her favourites. This will has not entered probate yet because of fast moving beneficiaries (5% lot)

Q.3. What factors can ill-health help when proving the deceased would have had difficulty understanding contents of a will?
    Deceased had poor memory recall!

    Background

The will differs vastly from a previous will with 17 new beneficiaries which no longer include the deceased own brother, first cousins and closest confidants/friends.

Arranged here means - she made the appointment with the will writers (not solicitors) and was named as the contact person before and after death. The deceased had significant health issues including AD, memory loss, sight and hearing difficulties and would have been heavily reliant on someone reading Ts and Cs for the will writer's contract and the terms that were in the will he signed.
