  • I have a problem.

    In May 22 my unmarried co habiting partner of 28 years died of cancer it was quite quick and has left me devastated.
    In family meetings we discussed her estate. her to be given investments to her daughter of some 130k . The house was and had been joint tenants for 28 years. I gave her 20% equity in 1994. I spent 10 years investing in houses with my own money not hers as we moved up the Housing ladder.
    We ended up in a house worth some £800k when she sadly contracted cancer.
    We agreed on her survivors DWP pension to me and the death in service.
    to cover my time here until my step daughter bought the house and my 80% equity. She later renagued on her mothers wishes and bought a similar house of similar value. She did not tell me probate had been granted so I was late finding out and actioning a claim.
    She has also been busy trying to destroy my character and spending the money on a serous house extension. That’s her money as we agreed, it’s about my equity here and the deliberate way they in my eyes illegally gained it.
    just a week later I was told by my daughter and partner I would have to pay IHT on the house. if I obtained as we had always planned either of us would do on the death of the other the house we currently lived in. We never thought to legalise these arrangement as We trusted each other explicitly.
    I was shocked by that. I agreed to their suggestion of a severance at the agreed terms of 80/20 so that my partner share of 20 % could be left to my step daughter.
    I was told this would be written into the tenants in common. I before I signed the documents saw no boxes to tick regarding unequal shares. I was told that they would make sure it was written into the title by their solicitors. I trusted them.
    I was reassured and promised time and time again this had been done.
    I did not read her will only my own written at the same time again trusting them.
    I signed my will and she took it away and got them witnessed she signed her in my presence as well.
    Upon her death things changed.
    I discovered that she had done none of the things she promised.
    The house was now 50/50.
    I am embroiled in a court case at the moment and seeking provision from the estate.
    in short I was promised 80% to reflect my sole investments in the houses I had worked on and paid for. as this was for my retirement I have no other pensions only now my old age pension I am 66 years old.
    I was promised her pension. But this was worthless as it did not pay co habiting partners. she knew this before she died but did not tell me.
    My step daughter took the death in service.
    i was promised these things.
    Her notes regarding her will stated … he will not be happy with this will.
    He may contest this will
    I am financially up the creek so to speak as my daughter whom is no w estranged and aggressive toward me.
    I have done nothing wrong to either of them.
    My solicitor is seeking provision. Yet I am seeking
    To have the whole thing looked at. the false promises/ deceit/ manipulation and gas lighting.
    The will signing the deliberate act to make a gain for another with the severance.
    I was expecting to have my equity which I earned from this house. with that I could afford a small bungalow in the area I know and feel secure in.
