  • Tricky question re double (dual) probate.

    Q. If an executor ("executor one") has obtained a grant of probate with power reserved to another executor ("executor two") can executor one take out a caveat to prevent executor two from obtain a double grant? There are reasons as to why it is considered executor two must not receive a grant. A beneficiary has already taken out a caveat to prevent the second grant but HMCTS(Probate) simply reply that probate was granted (to first executor) last year.

    No mention has been made of preventing further (dual) grant and as usual an auto reply is all that has been received when the procedural question was raised with HMCTS.
