Background: I am the executor for the estate of my step-uncle who died intestate. His blood sister has signed Power of attorney to me to sort everything on her behalf and I have the appropriate letters of administration.
While sorting his estate, some shares in his step-fathers name have come to light. His step-father passed away in 1979 and his mother who took on that estate died in 2006. No one changed the name on the shares, although executorship was noted to first my uncles mother and then my uncle in their communications.
The share company now won’t allow me to sort the shares without Letters of Administration de Bonis Non. Which I have the form Cap A5C for - but there are 3 layers of executorship and I don’t think it that situation is covered by that form.
Is there any other way I can get the shares to sell them and divide the proceeds between the relevant parties on his mothers will? What happens if I can’t get them?
I feel like I’m going round in circles and no-one knows quite what to do (including conversations with both HMRC and the share company).
