  • Help! concerns with Executor

    Parent passed away allegedly Intestate, Sibling petitioned court using dative petition (Scottish law) without notifying Sibling(S), on obtaining Confirmation and on Confirmation Documention and inventory Inland revenue) fails to document Deceased's family ie, Siblings Children, GrandChildren, (apart from the Executor)
    Days after Confirmation was granted the Executor put (his/her) House up for sale, along with obtaining a surveyors Home report for Parents fully owned property this was obtained at start of the year and after Confirmation was granted)
    My question's are Would the Executor be able to use Deceased"s Parent's property as collateral for his/her new home by obtaining a mortgage on it or using all the above documentation to a lender as proof he/she has an impending inheritance available when Estate is finalised, many thanks in advance
