  • Will dispute and being appointed as Co Executor

    I am in England

    My dad was suddenly taken ill in hospital. A few days before he died my sister took in a diy will pack and got him to sign it with witnesses. She got herself appointed as Executor with me as a replacement executor. She also got herself a gift of £25,000 in the Will with everything else being split 50 / 50.

    The Will is currently is dispute as I don't believe my Dad had testimony capacity and knowledge / approval of the Will.

    I put in a Caveat to prevent her from being granted probate. It's my understanding that she was able to gain access to a small amount of the Estate funds without requiring probate.

    We are currently negotiating to see if we can come to an agreement regarding her gift of £25,000 and her status as sole executor.

    I asked her if she would agree to me being appointed as sole executor as I'm unhappy with her being the only executor.

    She said that her solicitor advised her that it would be impossible to make me or anyone else Co Executor but I have had advise to the contrary.

    Is it possible at this stage for her to make me a Co Executor?
