    Need some help. I had a situation where I was signed off work initially for 3 weeks after a major operation.

    My employer contacted me by phone the next working day asking me to come back to work. I informed them I couldn’t because I was in serious pain and drowsy from the pain killers as well as immobile.

    Unknown to me at the time, my employer contacted the company occupational Health doctor without my knowledge and consent to obtain a diagnosis stating that I was fit for work even though the doctor has never met me, spoken to me or spoken to my doctor.

    My employer with the assistance of HR concealed this from me and when I was referred to Occupational Health, they falsified I had given consent (I hadn’t) and further concealed their ‘crime’ by not sending me the OH report as legally obligated to. This is because it contained reference to a doctor statist I was fit for work a week after my operation. If I had seen the OH reports I would have said what doctor made that diagnosis.

    I fainted at work and was hospitalised

    I found what had happened 18 months later when after filing a work grievance I asked to see the records in my medical file as my employer lied in the grievance investigation.

    i want to know what legal torts I have in the civil courts. I believe it is profession negligence, medical negligence and fraud.

    i also want to go to the police but I’m not sure on what grounds I can say.

    I am not a legally knowledgeable person.

    Any help would he greatly appreciated.
