  • Moneyway refusing voluntary termination due to previous missed payment, can they?

In April 2011 I got a car on hire purchase as mine had been written off. Moneyway provided the HP.
In March & April 2012 I missed 2 payments, however these were then paid in full by the end of April and no further payments have been missed since.
I didn't sign any other further agreements etc after these missed payments.
I have now paid over 50% of the agreement.

I can no longer keep the car due to a change in circumstances and I hoped to send car back by voluntary termination (initial letter sent stating my rights to VT) but I've received a letter back stating because of the previous missed payment this is not possible as my agreement was terminated in April 2012.

Is there anything else I can do other than not paying and the car eventually being repossessed which I really do not want to do!!!

I have been in touch with CAB and consumer advice service who to be fair are not very helpful!

I've also just found a 'statement regarding my hire purchase agreement' from them dated 1st march 2013.
If they terminated my contract in April 2012 would they still send me an annual hire purchase statement?

On the bottom of the letter it says " this statement covers the period 01 April 2012 to 31 march 2013 and we'll send you a regular statement at least once a year until the agreement comes to an end".

Is this them saying we are still in agreement with them?
    Getting confused now.
