  • Finance Company want to Terminate Contract

    Hi everyone,

    A little bit of a back story on the situation. My vehicle was involved in an accident and on the day of the accident, the vehicle was taken either to an impound or nearby garage for me to pick up at a later convenient day. After the accident I did not feel well so I was unable to reach out to the garage in order to set up recovery to take it out of there, so about a week later I tried to get in contact with the garage that it was at however I had no response from them. Tried calling for a week and still had no response so I decided to leave it a week or so to allow them to open shop or something like that. So this is now 3 weeks after the accident. On the 4th week, I finally reach out the garage and I get told that the finance company have picked up the vehicle. I call the finance company and I am told that the vehicle has been sent to auction.

    Today they have sent me a letter saying the following. "We have given you until Sunday 3rd January to settle the finance and any charges applied in full to own the vehicle. If you would like to do this you would need to contact Grosvenor direct to discuss making the payment owed before arranging a collection. If the vehicle is not paid in full by 3rd January 2021 then we will look to proceed with terminating the account on 4th January, at which point the vehicle will be sold at auction for fair market value, depending on the condition of the vehicle."

    The finance company are telling me the reason behind this is that the vehicle was seized and it was a breach of contract, however, the vehicle was not seized at any point for any reason. Is there anything I can do to keep the contract continuing or if not get them to extend the deadline so it gives me time to pay the full settlement figure because allowing them to terminate the contract would ruin my credit file.

    My vehicle is a Volkswagen Golf R. Volkswagen Finance is who it was financed with and the settlement figure is £25,000.

    Any help would be grateful and appreciated.
