  • VT with alleged agreement termination

Hello, new to the forum and looking for some help and guidance.

I am trying to VT a hire-purchase agreement on behalf of a friend.

Payments have been made well over the 50% rule, probably around 60-70% paid.

So I sent the VT template to startline motor finance about 5 weeks ago.

They replied via email stating that I no longer have the right to terminate the agreement
as they terminated the agreement two and a half years ago (may 2017). And the only option is available is Voluntary Surrender.

Yet they still took payments after the alleged termination and did not repo.

So I sent a SAR to the nearest local office (50 miles away), but not to head office 400 miles away. This was exactly 4 weeks ago and no documents have been received to investigate alleged termination.

About a week ago I sent another SAR to head office (all mail sent signed for).

In the meantime they have been ringing/emailing my friend, I told her not to communicate over telephone we do it in writing only.

So a few days ago a collections officer visited my friends property and posted a short hand written letter 'to discuss the debt'. Unfortunately my friend did not see the vehicle they turned up in so may have been a pickup truck or not we don't know if they wanted to collect the vehicle.

Anyways the vehicle is not stored at my friends property, when we sent the VT we took car off road(SORN), cancelled insurance/tax and it is now stored on private property elsewhere.

I am but unsure on what to do next, I have requested documents and so far it looks like the first SAR is a failure.

I've read on the forums that some people have notified DVLA that they are no longer the registered keeper, inform the finance company the vehicle is now parked on private or public property to speed up the collection process.

Would this be the next reasonable step to take?
Or do I submit a formal complaint against the company inc FOS/ICO?
Or do we wait to see if the 2nd SAR request will be met?

    Thank you for any help
