  • Voluntary Termination not accepted

    Good evening all.

My partner wants to VT her car. She has paid more than 60% of the agreement off. We sent a letter to the finance lender (Creation) more than 4 weeks ago (letter was sent on 14/07/18 and received on 17/07/18) giving them two weeks to respond, who responded to say that we needed to contact the dealership directly, which I believe is incorrect. I have been on the phone to Creation again, and they are not accepting the VT. I mentioned section 12 of the Torts to sell the vehicle at auction, to which they responded that any balance outstanding from the sale still has to be settled, which again I believe is wrong. My partner has not stopped her Direct Debit payments yet as she is worried about doing so. Basically if she cancels her DD payments my thoughts are they will take notice that she is serious. What is the best way to move forward now? Should she stop her DD payments? Should we send another letter to Creation and inform them of intention to sell at auction? Any help would be greatly appreciated.

    Mike
