So I've recently received a PCN for parking in a restricted area from C.U.P Enforcement and I would like to side step the charge. To start off with the contravention date on the letter was way back 10th April 2022 however the notice date of the letter is the 8th July 2022. Why its taken them so long to send the fine is a mystery to me.
I've read through previous forums on this site and understand that under section 9 (2) (a) of the POFA the PCN must state the time at which the offence occurred, which mine does not. So I would like to explore this further.
The issue I have is that the car I drive is leased and therefore all correspondence regarding fines goes through the Lease company first, and they then provide C.U.P with a Third Party Authorisation letter which allows me to appeal the PCN (seeing as I am not the registered keeper). In the Third Party Authorisation letter it states my name as the Driver of the vehicle and it also gives my address. As I understand it, giving my name to C.U.P as the driver of the vehicle is the last thing I wanted to be doing, especially if I want to be using section 9 (2) (a) as my get out clause.
So I'm wondering what my next play is in this situation. Any help would be greatly appreciated.
