    So the ticket has been issued because the stay had not been validated, as sign in the picture above. Vehicle was only in the car park for about 15/20 mins. They do have CCTV and can clearly see driver images on appeal screen. Is above appeal still worth a try?

    If there was no ticket on the windscreen then this should do:

    Dear Sirs,

    I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.


    Yours etc.

    First class post with free certificate of postage from any post office.
    Or if on a web page then screen print of every page.

    There are other POFA fails on there but if they reject and give you a POLA code then an appeal to POPLA should be successful

    Sorry we missed your earlier post.

    Don't suppose you took pics of the site sign? (Long shot, I know!)

    Any chance of getting one?

    If it's like this (maybe 90 mins instead of 60), it could be challenged.

    We'd need to see the exact one(s)

    EXAMPLE



    Ps...do they have CCTV (as opposed to ANPR) on site?

    MET tend to go down the common law breach of contract route, rather than use the Protection of Freedoms Act 2012 (PoFA)

    If so they do need to ID the driver (no transferrance of liability) but *if they have CCTV........?

    *Our local one does.
