Can I pose a 'what if?' of a real situation but without naming names at this stage?
Here's the scenario:
A town council owns a town centre car park with parking regulated by an Off Street Parking Places Order
The TC later sells the car park to a well known supermarket, with the proviso that the car park is not for the exclusive use of that supermarket's customers, but also for 'local shoppers' (the presumption being to prevent commuter parking for rail users at the nearby railway station)
That supermarket then engages a well-known parking management company to keep an eye on the car park and manage its use, with a 1 1/2hr parking period, using ANPR.
That said PCM begins to issue parking tickets for overstays etc.
However, it seems that the town council hasn't ever rescinded the Off Street Parking Places Order that covered the car park.
Questions:
What is the position legally?
Does the OSPPO 'trump' any future parking arrangement between the supermarket and the well known PCM?
If so, do folk who have been sent PCN's have a ground for appeal?
Or does the new arrangement supercede the PCPPO?
I'd be very interested to hear your thoughts... especially in relation to those that have paid the demand if the PCN's were not actually validly issued
