Im wondering if you can help me, i got a parking fine last year (July 2015) From Met Parking at west ruislip station I paid for parking using the ringgo app, from My Phone, I didn't receive the text message straight away but got confirmation from the app that i had paid, their appears to of been a few Hours delay from either my Phone or the ringgo servers.
Both appeals (Met Parking and POPLA) have been rejected, I have asked POPLA on what grounds they reject my Appeal, Currently waiting on them to get back to me.
Met Parking stated that their was a Pay and Display Machine at West Ruislip, but their is not, I have asked the staff their on multiple occasions and have been told to use ring go, and i am not local to west ruislip, just work nearby and catch the train when going to london.
In the Mean time I have spoke to BPA, who Met Parking are a member of, and have been sent a copy of their Guide lines, whilst talking to them i was told by one of the ladies their that her local Train Station has got ride of the Traditional pay and display machine for a Hybrid Machine where you can buy both parking Tickets and Train tickets. (Ive attached a Copy of their Guide Lines)
This may have been the case, but none of the signs mention this, or the location of the pay and display machine.
If you read section 18.11Where there is any change in the terms and conditions that materially affects the motorist then you should make these clear on your signage. Where such changes impose liability where none previously existed then you should consider a grace period to allow regular visitors to the site to adjust and familiarise themselves with the changes.
Specifically "Where there is any change in the terms and conditions that materially affects the motorist then you should make these clear on your signage."
I fell they are breaking BPA's Code of Conduct here as not one if their signs Specifies the Location of the Pay and Display machines or the fact that they have changed over to a Pay and display machine that uses the Train Ticket Machine as well if this was the case.
Thoughts?
i have asked met parking the following who are refusing to answer my questions, as these question are classed as an appeal and the appeals process has ended.
1. The Training the staff at West Ruislip station on the location of the pay and display machines located their. (including the people that work in the train station)
2. where on the sign posts does it state where to find the pay and display machines.
3. Are you a member of BPA? if not the who?
4. What Regulations you follow for the location and what to put on the signs.
I'm Wondering could i use the Freedom of Information Act or something Similar to get them to answer the question, i know that it is for the public sector, but ive been reading that in some cases that this can include the private sector.
