I am a newbie looking for advice.
This summer our car was parked in a PPS car park. The machine was not accepting coins and also not accepting card payment. There was a note strapped to the machine which stated "No card payments" with no further instructions to ring Customer Services or anything.
The driver did not get in touch with the customer services phone number but took a photo of the amended signage just in case.
We have been sent a NTK etc. All looks like it's in date and follows correct procedure.
I followed all the advice on these posts and have not admitted who the driver was.
The keeper is getting pretty nervous and would rather pay and forget the matter.
The defence will be that the contract which was supposedly in place was not able to be met and the signage was contradictory (if I had rung the number I would have still been paying with a card...).
Given this - is it OK to name the driver so that the keeper can stop worrying.
Also advice on similar cases to prepare for the court case would be greatly appreciated
