I am new to posting and I am hoping that someone may have some sensible advice for me.
I received a parking fine from Premier Park in May 2015. I went to pay for a ticket, realised I hadn't got any money on me, walked over to my children in the adjacent park and told them I was moving the car, moved the car. This took me at the very most 3 minutes, but more likely 1-2 minutes.
No ticket on my car, but one received via post about 10 days later. This showed two photos of my car over a 22 second period.
I wrote to Premier Park explaining what had happened, they told me to appeal via POPLA. I did. I referred to points 13.1 and13.2 about allowing a period of grace for driver to decide whether to enter into a contract with operator.
I received confirmation of my appeal in June 2015. I have kept all my correspondence. I then heard nothing until I received a letter from Premier Park last week, dated 3rd September 2018 demanding £150 (Originally £60, then £100 if appeal rejected - which has never been offered to me) and giving me 14 days to pay.
This letter was swiftly followed by another letter from Premier Park dated 7th September 2018. The amount has increased to £170 with no notification and given me 30 days to complete and return legal forms.
I contacted POPLA. They said they have no knowledge of my original appeal as I originally appealed when they were under London Councils. I do have the orginal appeal acknowledgement and number, but it now says it is invalid.
Where do I go from here. Do I just pay - which seems extremely unjust, as I did not park my car after I realised I could not pay the charges. If I keep fighting am I likely to end up going to court and if so how much is that likely to cost me?
