  • Statutory Declaration

A friend has been convicted of a minor offence.

They were unaware of proceedings - their own fault - not updating V5C.

They became aware with calls from a recovery agent and paid the fairly large sum demanded

No documentation has been provided as yet, though it has been requested. Intent is to file an SD and the case dealt with by SJPN.

    Some questions:-

    1) When does the 21 day clock start for the SD. Is ot when they became aware via phone calls or when the details of the underlying warrant are provided (current adress differs from that which proceedings were issued to).

    2) In the absence of any documentation how fan I find out the case reference number and convicting xourt (nb I expect it would have been dealt with via SJPN and it would appear to tje system as simply ignored).

    3) Can the amount paid to the recovery agents be reclaimed and if so can all of it be reclaimed ? (The bulk of it was probably their fees). If it can be reclaimed what is the process ?

    Thank you
