  • Transfer of Equity help

    Hi there,

I'm in the process of getting divorced, and wanting to purchase my ex-wife's share of the house from her, which she's happy with so no issue there.

I've also found a solicitor for myself to complete that Transfer of Equity for me, which seems to mostly involve removing her from the mortgage / getting a new mortgage and removing her from the Land Registry documentation.

However, I believe that my ex will also need someone to represent her. We're having slightly more difficulty finding someone for this. My solicitor couldn't represent her as well anyway, but they said even if that wasn't the case, they never represent the person coming off the mortgage. I don't really understand that. Another solicitor said they can't take her on due to having too much work, and another said they charge £125 just for an initial telephone consultation on the issue.

Does anyone have any experience in this area and know of any pitfalls? Does she definitely need a solicitor for this? What do we ask them to do for her? Should it cost about the same as what I'm being charged?

    many thanks!
