I have been separated from my spouse for approx. 3 years but are legally still married and we get on fine. I work for him. I am currently removing his title/equity by remortgaging in my sole name (the house was mine originally and he was put on the mortgage when we purchased a small plot of land some years ago). He has no objection to removing his liability from the mortgage and will sign over willingly. I have instructed solicitors thru mortgage provider (same as original provider) for my part but wondered what costs would be associated with his part of the Transfer of Equity to me - no money is changing hands between us. I am told that we can't use the same solicitor - which makes sense, but it would also make good sense if it was allowed. I would very much appreciate if any of you legal peoples can advise me on these costs - I was looking to pay his costs.
