    Hi,

    First time posting on here so, bear with me and if you require more details Judt let me know and I will send them through. That said, I'm mindful of not doing chapter and verse as there's a likelihood you'd be reading this until the end of time therefore, I'm going to attempt to provide you with a short version.

    So here goes nothing... I'm in the latter stages of completing on the mortgage for property which belonged to my amazing mum who passed away in 2012. Unfortunately it's come to light that my mum had a 2nd and 3rd charge on the property which were both equitable charges by an interim order by MBNA Europe.
    This has put a stop to proceedings as my solicitor has understandably asked whether I or, my solicitors managing the probate have discussed paying off these charges. I todate haven't had any discussions with regards to these charges but, I'm willing to do so and given that I pursued probate without a solicitor the onus would again fall to me in this instance.

    Anyway long story short...see I'll get there eventually. What would you advise my best course of action should be in this instance as, there is no equity in the property? I believe the total debt is £16k and I wouldn't be able to pay this off but, Do you think it's worth me making an offer of settlement maybe?

    What would advise my best course of action should be?

    It's worth noting that the current mortgage vendor on my mums property is Bank of Scotland whom I've been having issues with which is why I wish to take it elsewhere. The current mortgage with Bank of Scotland is interest only hence why I wish to remortgage.

    My mortgage in principle which I've managed to secure with Santander runs out on 31st of March 2017 just to add fuel to the fire so, the clock is ticking. Given time constraints should I look to extend this as these charges only came to light at 4.56pm yesterday and I was hoping to complete by next Friday?

    Again unsure what is the best course of action to take and I feel as though everything is against me?

    My mum had no family. It was just me, my little sis and my mum so, it's me against the world on this one.
