  • Transferring a Secure Council Tenancy to Son after being Widowed

    My new husband is a secure council tenant. He would like to assign the tenancy to his eldest son so his two grown up sons may remain in the house. Unfortunately, he had a joint tenancy and when he was widowed it passed to him and so the single transfer allowed under the Housing Act 1988 has occurred.

    His sons do not want to live with us (not that we are living together yet for various reasons) although they are welcome to as they (understandably) do not want to leave the area they grew up in. They cannot afford to privately rent and we are concerned that as two adult single earning (albeit low earners) people with no dependants they are probably not a high priority.

    The council has said that he could apply for a court order to assign the tenancy to his eldest son by I am wondering how much this would cost and what would be the likelihood of success.

    Any advice would be welcomed.
