  • Eviction Notice

Hi, I was wondering if anyone can direct me on where I go with this.

My landlord has served me with an eviction notice under Section 8.

The witness statement was served on me and signed by her long term partner who has put a totally different address to the one he actually lives at.

This is minor I think in the grand scheme of things as - I was aware that I had arrears of around £900 and had made an arrangement with the landlord that I would pay this off as I could in addition to monthly rent. I had made a payment of £50 and 1 of £100.

The notice that has been served has stated I owe arrears of £5980 !!

A ''dummy'' rent book has been attached as ''proof'' of payments however these do not tie up with the payments I have made at all.

Luckily I have made payments via bank transfer or cash over the counter at the bank (for which I have receipts). For example, the payments for February and March this year are showing as unpaid and clearly marked on the rent book copy as unpaid, my bank has confirmed paid.

I honestly think that I am going mad.

Also at one point in 2010 they employed an agent so I paid to the agent - I paid the rent of £800 however they have credited only £675 to my rent account as the rest went for the agents fees. Surely this isn't correct?

The house needs some repairs (all noted at the time I moved in and promised to be done) however they have never been done and some situations have deteriorated such as leaking toilet and boiler. The landlord refused to do repairs as I was in arrears - I accepted that on the understanding that once the £900 paid then they would come in and sort all the issues out.

Also I haven't had a new gas safety cert apart form the original when I moved in back in 2008 despite asking repeatedly as the boiler is faulty - leaking water not gas - I have to empty buckets of water on a daily basis.

I don't particularly want to move although family are fed up with the visits from the landlord asking for the arrears despite them knowing my situation and I'm trying to resolve it (albeit bit by bit).

Would you think a visit to a solicitor would be good here as I can prove my payments and currently the letter says they will be charging daily interest of £28 so this could soon become silly.

    Thanks in advance.
