  • Mortgage / Break Up Advice Needed

    First post. I share a mortgage with my now ex partner (we broke up at the start of January and after an argument whilst I was intoxicated he got a protection order on myself and had me temporarily removed from the property). The order ended in February but I've remained out of the property since.

    I paid all January bills for the property in advance myself before leaving and had offered to continue paying 50% of the mortgage on the basis we were selling the property.

    I was advised in February by email from my ex that there was a hold on the mortgage and all payments had been frozen for 3 months however after contacting the company throughout the end of March and early April have established no arrangement had been set up by my ex and that he had not spoken to the company, he had simply stopped paying them.

    He is currently unable and unwilling to pay anything to the mortgage but will not leave the property. I am willing to pay my share, or if he is willing to leave the property all of the mortgage myself, but he is refusing to leave or pay anything.

    Is there anything I can do legally to resolve this issue and either force my ex to make his fair share of the payments (more than fair given I do not live there) or force him out of the property if I agree to pay in full myself?

    I should note moving back into the property with him poses a risk to myself physically and mentally and could have implications on my employment if he decides to ring the police on me (whether I do anything or not).
