  • Private Road Agreement

    Hello,

New here and first post, so please be nice .*

We live in a private road so it is maintained and managed by a private company, rather than the local council. There is a covenant (I think it’s called) as part of our deeds that we had to agree to pay the management company a maintenance fee each year.

We have lived here just short of 8 years and so far have received about 3 bills from the management company, which we have paid. For the last 5 years we have not been billed by the company. This appears to be the same with our neighbours. Some neighbours say they have never been billed or have never paid it.

We have heard from some neighbours who have sold their houses that they are being billed at the point of sale for the full amount that they owe (so we’d owe 5 years say). Just wondering what the legal stance would be on this. Is there an onus on the management company to bill us regularly? Are we legally obliged to pay at the end of our tenancy?

    Any thoughts welcomed......
