Hi, really need some advice please..
My mum passed away in February and left her half of the house she shared with her partner to brother and me.
We are in receipt of probate. It was decided before my mum passed that the house would be sold and is on the market, there hasn't been much interest and my husnand and I are now thinking of buying out my mum's partner and brother. The is no outstanding mortgage on the property.
We have a house which we are in the process of selling.
I have a few questions..
The deed to the house is still in my Mum and partners names - do we need to change this now or can this be done when the house is sold?
If we decide to buy out the others would we pay stamp duty?
How would the mortgage process work in this case, as my deposit would be in the house value, we would just need a mortgage for the others share.
Is this legally a straight forward matter? would the conveyancing process be shorter as we wouldn't need surveys or searches.
Would it also be cheaper?
