my wife and I recently purchased a 4 year old house. The house was originally sold with a 10 year NHBC warranty. The developer provided an enhanced component to the warranty by retaining liability for repairs for the first 5 years post completion rather than the first 2 years, as its normal with the NHBC warranty.
We submitted a claim to the developer but their response was that their enhanced guarantee was not transferable. We asked them to provide the specific clause in the guarantee document that stated this element of the warranty was not transferable. They don't seem able to do this.
Am I correct in thinking that warranties by default are transferable unless there is a specific term to the contrary in the guarantee documentation?
