Hello,
We live in a 3 storey block of flats, a total of 8 flats on the top 2 floors and a parking area and business unit on the ground floor. All are privately owned, 2 are rented out.
Back in the summer the business unit installed a cigarette butt bin on the side of the block without asking anyone's permission. Over the course of the summer, the smell from this got worse and worse to the point where we cannot open our windows without the flat stinking of smoke. Even with the windows closed, the smell is still seeping in.
We have asked the managing agent to get the to take it down or move it but he seems reluctant to get involved and we have now written a letter to the business unit asking for the same.
My wife is at home most of the day and she cannot enjoy our flat as she should be able to.
Where do we stand legally with this ?
