Hello.
I am wondering if anybody could tell me the procedure for adding a party to a counter claim please.
I entered into an agreement with Ms X who claims that I owe her money, however I claim that she has not fulfilled the agreement and owes me money.
However, it is her boyfriend Mr Y who started a claim against me. He clams that they were acting together, but I had no contact with him at all.
I have defended and also counter claimed via MCOL, but that defence and counter claim are against Mr Y.
I feel that the claim should, properly, be struck out and brought by Ms X instead (or at least Ms X and Mr Y), but if that does not happen, how do I:
1) Amend my defence to state that Mr Y does not have standing to bring the claim (or that any liability would be to Ms X), and/or
2) Amend my counter claim to include Ms X as a defendant
I feel like I have made a mess of this, so any thoughts would be greatly appreciated.
