  • Abuse of process?

    Hi

    Go easy on me please I may have made a school girl error.

    I logged a claim in the small claims court for a very small amount. I later lodged a claim against the same defendant arising from materially the same circumstances in the county court for an amount outside of the SCC remit. I didn't have the information I needed on the second claim at the time the first was issued so I couldn't have done them together.

    However the defendant is now saying 'abuse of process' and also stating that I should have amended original POC but could I have done this when the orginal claim was allocated already?

    Bit of advice please as I don't want my claim struck out for abuse of process.
