  • Small claims case fraud

    Hi,

I filed a small claims case against a company and something odd happened.
I had a hearing with a judge scheduled at a particular date. When it came close to the hearing time I was waiting for the email they usually send as they said this is a remote hearing via video call. I checked my emails but nothing from the court office with a link. Then a few minutes before the scheduled time, I email the court asking what's going on as I haven't yet received a link.

To my amazement they replied back saying:

"The case has been discontinued and the hearing vacated"

I was obviously confused and asked what does that mean. They replied back saying that the claimant has filed a notice to discontinue. This was a few days before the hearing.
I replied back saying that I am the claimant and I didn't file a notice to discontinue, what's going on?

Then they came back and said apparently I sent this email to them below.

    "Hi

I, 1st Claimant, (my name), have settled the case with 1st defendant (company name), therefore I don't need to continue with the case.

    Please close the case."

The From address on this email they sent to me was my actual email address! (Google sender address spoofing)

I then replied back saying that wasn't me, please open the case again and escalate to your IT security team.

This was all a few days ago and they haven't got back to me yet. Anyone seen this before? Shall I inform the police? What is going on?

    Thank you
