  • investigated for criminal damage

Hoping someone here would be able to give me some advice. My friend is mentally ill and has been diagnosed with schizophrenia and psychosis. She is currently in a psychiatric ward were she had an incident the first day in which she broke a television and a toaster out of rage and had to be restraint. We were told today by the police that the ward are looking to prosecute and charge her with criminal damage. Are they able to do this as she is very mentally ill?

The rage was caused because she had not taking her medication and was refusing to beforehand. Since on the medication, we have been told that they have had no problems with her while she has been at the ward.

We had been asking the doctors for almost a year to try and get them to section her as she had displayed aggression towards other people along with other things but they didn't listen. It was only until she attacked a family member for the second time (the previous time she was charged by the police) when the police stepped in and got her sectioned.

I just want to if anyone can tell me what may happen in this situation? So far we have only been told that they are investigating her. We are in the UK for anyone who is wondering.

    Sorry for the long post.
    Thanks
