Ok, this may or not be straight forward.
I have recentlyleft my ex partner of 17 years together, it was not amicable and now she hasmade many claims to the police including abuse and such like.
My problems isthis, she continued to harass me by text for which I responded politely. The police resolved this issue by way ofissuing us both a PIN (public Information Notice). This means I can’t contacther and she can’t contact me. Anyway was some items I reported to the police 4months ago that I reported stolen and the police have searched her home. I wasinformed that the only items of mine were a suitcase and a pool cue.
Now hereis my nightmare.I left with only my cloths and a few other items an I accumulated a lot of personalitems including a twin axle trailer, all my sports equipment, and tools... blabla bla. I did txt her before I was issued with the PIN when I could collect my items but had no reply. I asked the police what could I do about it and they told me as we lived together for over 6 months it was a civil matter, Is this correct because as I understandit;
Rights in certain household goods
It is presumed thateach cohabitant has a right to an equal share in “household goods” acquired(other than by way of inheritance or gift from a third party) during the periodof cohabitation.
And “household goods”are, broadly speaking, any goods kept or used at any time during thecohabitation in any residence in which the cohabitants are (or were) cohabitingfor their “joint domestic purposes”, excluding:
(a) money;
(b) shares or securities;
(c) any car, caravan or other road vehicle; or
(d) any domestic animal.
So, for examplehousehold furniture; a cooker; white goods; kitchen utensils; kitchenappliances; television; CD player, and radio would all be covered as being usedfor “joint domestic purposes”. But, e.g., a wrist watch or jewellery would notbe included as these are not used for “joint domestic purposes”.
The presumption onlyapplies to “household goods”: so it does not include the familyhome.
My question is how if I have a course of action is the bestcheapest route to take.
