  • Can my employer make me work away from home?

    I am employed in the management side of construction, based mainly at the head office in the north of England and I have to visit site once or twice per week. The visits can be done in a day if I set off early and leave late. I don't mind, I have done this for over 10 years and sometimes I stay overnight at my discretion.

    In recent months I have gotten the feeling that my new boss dislikes me because I am more qualified than he is. He's only in the position because he has the gift of the gab and gets by on BS. How the MD has missed it I will never know.

    He has asked me to oversee a job in London ( we haven't won it yet) which will entail being away from home 2 - 3 nights per week. I have told him that I have a family and am not prepared to work away from home without more money. He refused and implied that if I refused then I would be sacked.

    I have checked my contract and it doesn't say anything about staying away from home. It says what my hours of work are and includes a phrase that I may need to work extra hours if necessary to perform my duties. Surely, this cannot be wide enough to mean working away from home?

    I told him that I may have to resign and would advise him in due course of my decision.

    if I do resign, do I have a claim for constructive dismissal and if so what should I do to crystallise this fact, that is help me to convince an employment tribunal.
