  • Redundancy prior to TUPE

    Good morning all,
    I'm looking to find a little help/advice/ideas/thoughts on the situation I am in as I am not sure of the legality of it. Anything people can contribute will be appreciated as it will help not only myself but a number of others in the same position.

    The company I currently work for was acquired by a competitor earlier this year. At present we are a wholly owned subsidary of a group and therefore I believe a separate legal entity and business (please correct me if I am wrong).
    We have now entered into a number of phases prior to TUPE which will essentially involve redundancies for a large component of the sales team.
    Under the proposals set out by the acquiring company are having our senior management handle the consultation but any viable jobs are being handled by them.

    My question for this is such:
    Under current redundancy and/or TUPE regulations can one company put me through the redundancy process with another (prior to TUPE so my contract has not changed ownership so to speak) offering the "suitable position(s)" as part of the redundancy process?
    There are other parts to consider such as the new base of work will be 40-50 miles away for some people and therefore has significant impact on the working day and cost but I don't think that falls into it all - or does it?

    Any help is gratefully received.
