I'm going through a constructive dismissal claim and need advice around the compensatory award.
I worked for my employer for 34 years and throughout this time I paid into the pension scheme.
I had carried out the same role for the last 20 years which is quite specialised.
My pension allows early retirement at 55 years on full pension. In order to claim full pension at 55 years you must be working an paying pension at the time of pension allocation. You cannot resign and take full pension early..your pension age returns to 60 years.
I was always intending to retire on full pension at 55 years as do most people in my profession
As I had to resign I had to take my pension at 53 years which incurred a significant actuarial reduction. I felt I had no choice or not be able to claim my pension until 60 years.
Would my decision be seen as reasonable and could I claim my pension loss because of the actuarial reduction
