  • Investigation in the Workplace - Potential problems and Protection

    Ok, first of all, this is not an investigation regarding anything I have done but I am involved as a witness and I was hoping for some advice

    A colleague that I sit next to in the workplace has been suspended on full pay for his behaviour at a recent work event - I was also sat next to him at the event and so, I am involved in the investigation and have been interviewed.

    Three colleagues separately reported him for getting a knife out at the event while sat next to me (I didn't see it) and so that is partly why he has been suspended. To add to this, he was also caught drawing antisemite logos on his notepad on the day as well writing things about a guest speaker who happened to be gay. As he was writing the notes, he was sliding them under my nose and after I had read the first few and realised what he was doing I stopped reading them but he continued to push them under my nose - it was a horrid, horrid situation and people saw what he was doing - so I couldn't deny it if I wanted to - the notepad was taken from the table by a member of staff so they have it in their possession.

    Anyhow, he was suspended and marched off the premises and has been out of the office for over a week and in that time I have been interviewed and today I have had my interview transcript back and I have to say that I am very very worried.

    First of all, my transcript will be shown to him if the investigation goes to a disciplinary. Obviously, the claims of a knife concern me if he takes offence to my interview transcript and any kind of risk or concern is enough to to make me feel uneasy.

    Secondly, what protection should my employer offer me and other staff as a result of his possible actions, his views and the fact that he will read the transcripts of all interviews if it goes to a disciplinary (which it should).

    Finally, if he did come back to work for whatever reason, the fact that I know he has these views and was reported to be seen with knife is a massive concern and makes me feel very uncomfortable.

    Is there anything that can be done at this stage? Anything that I can say or do? I believe the police should have been called immediately but they were not and this is where I believe the first error was made.

    I really hope someone can provide some advice as I feel that I have been roped into something that has become rather messy and could become messy plus I am genuinely concerned for my safety if he returns or not.
