Hi everyone,
Apologies but this is the first time I’ve ever posted in a forum so please excuse any mistakes!
I need some advice in relation to closing a company pending prosecution.
In essence I took over a company 5 months ago and am the director. The business is letting properties as HMOs.
I was not fully aware of licensing laws of hmos when I took over but the council attended a property which requires a HMO licence and did not have one (more than 4 occupants).
They are now looking at prosecuting the company for failing to have a licence and this is a criminal offence (can be fined only). It is a limited company.
Does anyone know if I can dissolve the company? And what does this mean for my liabilities as the director. The company has a small £2k debt to an energy supplier which is being paid monthly but I can pay this in full. No other debts.
