              If this is for an overdraft on a current account then the CCA is not relevant.

                    Do you have very much in the way of old statements on the account to show where and how it went a bit crazy to end up at £8k?

                    You mentioned a letter from January 2008 - any chance you could upload that?

                    Also what happened with the cheques that went out / bounced in Feb/March 08 ?

                    Had you made any complaints to Lloyds since the charges started accruing on the account ? was there a dispute at the time you stopped using the account ?

                      I have some old statements from the account. Think the last cheques bounced. I'll go through the filing cabinet tomorrow and see exactly what I have left.
                      I think it went up from 2-400 each month in charges.

                            the date your defence would be due ( ie 28 days from service or 33 days from the date of issue printed on the form)

                                Some lovely Lloyds pretending to be solicitors letters there.

                                So we need to work out how the amount rose from £3200 in January 2008
                                £3470 in February and March 2008
                                when in January 2008, when the balance was £3200 you had a letter from Lloyds telling you the facilities had been blocked to ''prevent your balance from increasing''.

                                TO the current claim of £8k.

                                You need to send a subject access request under the data protection act to Lloyds to find that out, this should give you the transaction lists on the account - you need them since at least Jan 2008 - hopefully further back to see how the £3200 occurred in the first place, how much was charges.

                                The bounced cheques in Feb/March 08 need looking into so if you have records of those that would be useful to dig out.

                                Balance £3200 - Overdraft formal demand sent Dec07/Jan 08

                                No payments into the account since sept 07
                                Last cheque cashed/returned Feb 08
                                Balance £3400 No activity other than charges since March 08
