  • Recieved Claim Form for CCBC from Cabot Financial

    Hi

    I need some help and advice please

    Ive received a Claim Form for CCBC from Cabot Financial on Friday for a debt for a old Fluid Card i had

    Im unsure if the amount is correct to be honest

    Any help with what to do and how to proceed would be great

    Im willing to accept i owe something but i dont accept the amount there asking for any help would be greatly appreciated as i dont know how to proceed

      You need to Acknowledge Service within the first 14 days, that can be done online, that gives you 14 + 14 days, so that 28 days plus 5 for postage.

      a) Send a CCA to their solicitors, they have 12 days to respond (keep an eye on that). Make sure you get Proof of Postage

      b) Send a 31.14 request, to their solicitors, they have 7 days to respond after receipt of letter (keep an eye on that). Make sure you get Proof of Postage.

      c) You could also send a SAR to the original creditor, they have 30 days to provide all the data on the account, make sure you get Proof of Postage.

      Work out the date your defence has to be lodged with the Court and the creditors solicitor, note it in the diary, do not forget.

        Original Creditor:FLUID
        Original Debt Credit Card
        Particulars of Claim:By an agreement between New Day RE Fluid & the Defendant on or around 22/08/2019 ( the Agreement) New Day RE Fluid agreed to issue the Defendant with a credit card. The Defendant failed to make the minimum payments due. The Agreement was terminated following the service of a default notice. The agreement was assigned to the claimant The Claimant therefore claims 1 618.51 2 Costs
        Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?):
        List any letters you have sent Not sent any as yet
        Any Other Information or Background Details: I know i owe them but im unsure on the amount and im willing to pay them but only for the amount i owe and over a period of time as im struggling with everyday bills etc

            If things couldnt get worse i cant login and when i reset the password theres no option to reset it so im going round in circles anyone know how i can get logged in

              Delete cookies or you could try a different browser. I've made Admin aware of your problem.

                Ive tried that now im getting this You cannot recover your Government Gateway user ID online

                This is because there is more than one Government Gateway user ID associated with the email address


                Whats the best way to proceed

                    Hi

                    Its https://www.access.service.gov.uk/login/signin/creds

                    Im getting
                    Enter a valid user ID and password. You will be locked out for 2 hours if you enter the wrong details 5 times

                    Shall i Contact MOJ by phone to try and sort my login out?

                          Is there anyway i can get this extended as im running out of time

                          ive received this back

                          We aim to respond to your emails within 10 working days, but ask that you do not resend any requests or chase for a response before 20 working days have passed. Any duplicate emails will be deleted without response.

                            Fill in the Acknowledge of Service form manually, then post it 'Next day delivery'.
