  • Default Judgment or Response to Court?

    I'm currently in Litigation as a Claimant.

    I received a Notice of Issue which advised the defendant had until 31st October 2022 to respond.

    I received a Notice of Proposed Allocation to the Small Claims Track (dated 21st November) advising it is now a defended claim.
    To which I filed a Directions Questionnaire (N180). I sent this off 7th Dec (I had to reply by 8th Dec)

    I now have a "Notice of Acknowledgement of Service has been filed" (dated 5th December).
    They advised me the defendant filed an Acknowledgement of Service on 11th November 2022 (11 days after deadline)
    It also says the defendant has indicated that the correct name is different to which I originally stated.
    It is not, they are just trying to throw me off and I want to keep going with the claim with the name I filed.

    The court are now "awaiting my response or formal application (N244)".

    I didn't know if I could request a default judgement?
    Do I need to deal with the request to change the name of the defendant?
    Any advice how to proceed?
    Any help is appreciated.
