Hi everyone - new to the forum and have joined to get some advice on where we stand regarding a car purchase and subsequent repair:
We bought a car from a dealer on 28th May 2022 using finance supplied by a third party. The car came with a six month warranty. Within 14 days the car required new brake pads - we notified the dealer and he arranged to put it right for us. Four months later (22nd October) the car developed a separate problem (faulty differential). This time we contacted the warranty company who told us that our car didn't have a warranty with them. We contacted the dealer who lied, telling us that he was 'still in the process' of sorting the warranty but again he'll fix the differential. So far the car has now been with the garage for four and a half weeks and we've now been told that there is no part in the UK to fix it with. We've incurred £600 of car hire costs as this was our only car. We are now considering our options, and believe that under the consumer credit act we are entitled to a refund as the car developed a second fault after the first one was fixed within the requisite 6 month period - with the burden of proof on the dealer as it's within the 6 month period. The dealer is telling us that as the agreement is with the finance company, we only have a right to a refund in the first 30 days and after that the burden of proof is on us. The total refund would be £13k. Can anyone advise us who is right and what the best course of action is? We notified the dealer last Friday (25th) that we intend to pursue a refund to ensure he had notice within the 6 month period.
