Dear Mr Baskind,


I refer you to a letter from Cohen Cramer dated ,,,,,,,,,,,,,,,,,,,,,,,,,,, in regard to the CC claim No. C5GK9061 struck out by DDJ Murray- Smith on 23rd February 2016 I am rather surprised that Cohen Cramer is not aware of the reasons for the DD Judges decision.

However Cohen Cramer has now on behalf of it's client certain documents that it claims may lead to judgment in favour of its client if put before a court. I am however not convinced by this argument nor do I believe that the documents provided meet the requirements of a true copy of an agreement or a reconstituted true copy and the document is therefore rejected for reasons that I am sure you are aware.

I have attached herewith a copy of the application form supplied for ease of reference.

Should your client decide either to challenge the strike out or reissue proceedings any such action will be robustly defended.
Your early confirmation that this matter is now closed would be appreciated.

Encl: Attach a copy of the application form.

Well my opinion is that this is an attempt at making a " reconstituted " agreement" the " application form I think has been reconstructed without consideration for the need for producing T's & C's and does not comply with a CCS request.

There is no agreement, they sent me a screen shot of what they say is the application online but I cannot uploaded as I dont have the tools to edit my name etc. It contains my name and address and my place of work , that is it. The default date on the notice is 21st of Feb 2013.

I'm sure either [MENTION=6]Amethyst[/MENTION] or [MENTION=49370]Kati[/MENTION] would accept the agreement by e-mail and redact it for you prior to posting.

Can you clarify the date of issue on the DN please.

they would have to apply to the court for permission to bring the claim again, they have been sanctioned by being struck out, it is unlikely the court will allow a second bite of the cherry - particularly as they have still failed to comply with the CCA 1974 and supply you with a copy of the agreement - it matters not that you opened the account online - they are obliged to send a copy of the agreement, the terms you agreed to at the point you opened the account and the terms as varied before the account defaulted.

Digital signature application

The letter from the solicitors does state at point 1 that the copy agreement with digital sig is attached - but it isnt? - just the letter from Vanquis which states they won't give it to you?
