    You will need to apply to strike on the grounds they have already had a claim on the same cause of action struck out, and as such this claim is an abuse of process, but it is worth writing to them first with a copy of the strike out notice.

    Do I still need to do the usual process , acknowledge the claim intending to defend ?

    So presumably they didn't argue the strike out previously then? so no relief from sanctions.

    Same solicitors ?

    You will need to apply to strike on the grounds they have already had a claim on the same cause of action struck out, and as such this claim is an abuse of process, but it is worth writing to them first with a copy of the strike out notice.

    Dear Mr Baskind,


    I refer you to a letter from Cohen Cramer dated ,,,,,,,,,,,,,,,,,,,,,,,,,,, in regard to the CC claim No. C5GK9061 struck out by DDJ Murray- Smith on 23rd February 2016 I am rather surprised that Cohen Cramer is not aware of the reasons for the DD Judges decision.

    However Cohen Cramer has now on behalf of it's client certain documents that it claims may lead to judgment in favour of its client if put before a court. I am however not convinced by this argument nor do I believe that the documents provided meet the requirements of a true copy of an agreement or a reconstituted true copy and the document is therefore rejected for reasons that I am sure you are aware.

    I have attached herewith a copy of the application form supplied for ease of reference.

    Should your client decide either to challenge the strike out or reissue proceedings any such action will be robustly defended.
    Your early confirmation that this matter is now closed would be appreciated.

    Encl: Attach a copy of the application form.
