I need your help. My fiance yesterday received a letter from the County court business centre. It relates to a minor car accident she had on 14/02/15. it was her fault and she accepted liability. We kept in constant contact with the insurance company (Swinton) for a few months afterwards but not recently. Thinking the claim had been settled, which clearly it hasn't.
The claimant is asking for personal damages to his car to the sum of £6,033 (includes legal and court fees).
My finance is going to call Swinton this morning but I'm guessing they won't have any knowledge of the separate personal claim,
I have read somewhere you have to include a letter with the court documentation you send the insurance company stating that Swinton has to get it sorted within the 14 days stated on the form. Otherwise they are liable to remove the CCJ again my finance record?.
Can someone advise me what we need to include in this letter and any useful actions to take.
At present, I'm really concerned as we are in the process of obtaining a mortage in the next 6 months and a CCJ won't help in the slightest.
