    Don't bother. Enjoy your holiday and forget about it. Sort it out when you come home. If you find out their is a default on holiday it will spoil your holiday. And there will be nothing you can do to sort it.

    Plus your mum will probably/possibly get you locked out of them. They ask things like what account did you open in 2005... I just made educated guesses, but if someone does it who isn't you and you get logged out it causes a headache.

    Just realised a certain irony... It's actually more difficult to get access to your own credit file than it is to open up a phone contract in this country!

        Hello everybody,

        Just a quick update. I filed by defence with the court. I then received a letter a letter from the court, confirming my defence and giving Mr Carter 28 days to file his acknowlegement, failing that the claim is stayed, the claimant would have to apply to the court to have it lifted. I'm not sure what this means. In between this Mr Cater sent me a letter confirming his client, Lowells are prepared to go into mediation and to contact them. They have also sent me a contract to sign like a court order confirming not to issue a CCJ if I stick to the payment plan. They also said they can strike out my defence. I haven't signed anything yet. I then get another letter the day after telling me to wait on the court instructions for a hearing date. In the meantime Lowells have written to me and say they have sold the account onto Fredericksons, yet Mr Carter's letter confirm his client is Lowells. I'm not sure whether to just sit and wait and see if they decide to take me to court or can anybody help me with my next move. Any help with be greatly appreciated - thank you.

            Notice of proposed allocation to the smalls claims court - lowell portfolio

            Hello everybody. I am defending a Vodafone debt being chased by bryan carter on behalf of lowells. Today I have received from the court the above form. My question is - how I go about completing the n180. In the meantime Carter has sent me a Tomlin order and has said he can get the defence strike out. He has failed to provide any documentation. Lowells have written to say the debt was sold on to Fredericksons.

            Any advice on going forward with the n180 please.

              I'm sure you have a thread on this - you mind if I merge it together, makes it easier to help knowing the history.

              N180 should be quite straightforwards - if you have a look at Kelkie or rips threads you'll see the N180 and Tomlin orders are all quite standard procedure for Bryan Carter.

                  Hi everybody,

                  I received a Notice of Discountinuance with the above debt. I couldn't have done this without the help of everybody on this site. However 3 weeks after received the Notice Discoutinuance, Lowells are threatening legal action again for the same debt but under a difference reference number. Luckily I have kept a file with everyt single letter they have send me with all their court papers etc etc.

                  How do I respond to this? any advice please?

                    Well that's Good and Bad news.

                    I would write to Lowell enclosing a photocopy of the discontinuance notification from the court and reminding them that as they discontinued after defence they must apply to the court for permission (CPR Part 38.7 )to bring a new claim on the same cause of action
