  • Received Court Claim in joint names but I live abroad - do I dispute on Jurisdiction

    Hi everyone

I live outside the UK but own property there (in negative equity and cant sell). My husband still lives in the UK.

We owe service charges which we cannot afford to pay. We have asked other side to approach NRAM to pay same as we dont have a single cent (had to give up my job to look after autistic child).

Instead of doing that they have proceeded to send us court forms today. We cannot dispute the amount as we owe the service charges. They wont let us pay by installments. The total between the two is circa 7k.

My question is that given the court forms are in joint names can I claim dispute on basis of jurisdiction - living outside UK for 18mths plus.

Why do I want to do this? To buy some time to see will mortgage lender pay fees instead of admitting to claim and having CCJ against us which could affect husbands future employment (banking related)

Sorry to ask but really need some help on this.

    Thanks

ps we did receive bills asking for the money but hubby kept quiet about it as he thought I was stressed enough dealing with our sick child. :-(
