    If you have still had nothing from your CPR request and still are unsure what the debt applies to then yes you should submit your application for an order to disclose the documents which they intend to rely on in this claim (ie those mentioned in their particulars of claim).

    There should be a need to enter a defence as well, but it wouldn't hurt to put the basics of not recognising the debt and asking for information from claimant but it not being provided so have submitted an application separately in the defence form. The small problem of entering a defence before applying is the claim could be allocated to small claims where the relevant CPR isn't applicable, however you can't possible fully defend nor admit a claim which you don't know what it is based on accurately.

      I am sending the order (N244) as we speak and will wait until 12th March to submit my defence quoting the issues you raised. is there anything I need to be doing in the meantime?

            Well would you believe it! I send off the order today and when I get home a letter is waiting for me from Carter and i think oh damn they have responded to the 2nd request for the information.........how wrong could I be!!!
            what they have actually done is send me an exact copy of there first response to my first request!! i know its a copy as its word for word and has the same spelling mistakes!!

            these people are just out and out parasites, this has made me even more determined to see this through to the bitter end!!

            I presume I just let the court order carry on now?

              Good morning, I hope everyone had a lovely weekend?

              I'm now 3 days away from having to file a defence!! With regards to the court order I sent last week, what information should I receive from the court to say this has been issued ect? and should this extend the time I have to file a defence?

                Good Morning,

                I'm now desperate for a response today if possible?
                I've made a huge error!!! when I returned to my parents last night there was returned to me all the documents for the court order to carters, I had forgotten to sign section 11 of the N244 form... AAArrrgghhh!!!

                I can re-send it today but my defence is due tomorrow, what do I do now??

                Please help I'd hate to think I've come this far and fail at the last hurdle!!

                      If it's CCBC you can email it to: ccbcfees@hmcts.gsi.gov.uk
                      I sent an application last Thurs by email after ringing up to pay the fee and they emailed back Friday to say it had been sent to a DJ.

                        Resend the Docs signed,your defence can be they have failed to respond to your C.P.R, request and because of this you want there claim struck out.

                            The refusal to provide a copy of the contract also causes them a problem or two as how can you possibly defend a case with no docs, when the claim is founded on a contract.
                            Your defence is they have not supplied you with the docs you asked for as pointed out above,hopefully the unless order will sort this out.

                              The big day is here.....its defence day!!!

                              Ok so my case will be that carters refused to provide me with information about the debt so I cannot defend it correctly? Do I mention about the order that the court will receive today?

                                I've had an update and not sure how to or wether to respond?

                                The letter reads:

                                Dear Mr Evans

                                Please see attached copy letter sent to the court confirming that the claimant wishes to proceed with the claim at this time.

                                The claimant agrees in principle to mediation.

                                We should also be grateful to hear from you in relation to without predjudice negotiations and you may contact us on. 0845 ******


                                Hope someone can give me advice on what to do next?
