I am in a very unusual situation.
I am in debt and facing a charging order hearing on the 18th January. I have little or no information about the charging order and little of no information about my debts except there are approximately 20,000. The debts are held with Barclay's Bank and credit card, Virgin credit card and Egg. The debts were when I was living at Newport. I haven't come to any agreements with my creditors and not made aware of any CCJs.
A charging order has been placed on a jointly owned home which I haven't lived in for eight years as I am estranged from my ex partner. Naturally, I am worried about my ex partner suffering from a debt which she has no part in. My partner is also seriously ill. She tells me although I have had a lot of threatening letters to her address she hasn't found a CCJ amongst the mail, only the interim charging order with a hearing on the 18th of January.
My situation is I am seriously ill too and resident in Spain and too ill to come home and attend the charging order hearing. I am not a Spanish national therefore not on any benefits and still 4.5 years from my old age pension. I have approximately 50 Euros to live on a week. I do have a UK bank account.
Is there any help you can give on such little information about my circumstances. Needless to say I am very worried. I am worried as I have so little money and cannot attend the court hearing my creditors will eventually sue for bankruptcy or push for a 'sale order'
Can my ex partner claim a bigger share of my equity as she has serviced the mortgage and paid for all repairs and improvements for eight long years. Is this sufficient to stop an charging order.
