  • Court Claim in Scotland - wrong name of creditor and other errors

    On Friday I received a record-delivery letter from the Sheriff court in Scotland. PRA Group claim to have bought my debt in 2018 and are taking me to court - they claim that because I was used the card in August '15, the five-year limit is not over.
    To cut a long story short, I have three questions relating to the case against me for unpaid credit card debt. The Sheriff papers name a bank which I never took credit from, as the claim seems to be confusing that bank with another bank with a very similar name, so how would this affect the case against me? Also, I took the credit card out 6 months previous to what it is claimed on the Sheriff papers, again how would this affect my trial? And, finally, I originally took the credit card out and agreed a limit of £2000, but because I was paying my dues for close to two years, the balance kept automatically increasing if I recall correctly, to where the balance now stands at £3,200. How does that matter re the original credit agreement they claim to provide in court - I have looked over the forum for a large part of the weekend, and never found any topics at all on that matter. Basically, if the agreement was for X amount but they want Y amount, how does the court decide?
